California grocery and retail workers are protected by specific rules that many employers overlook: the right to a seat where work reasonably allows it, pay for time spent on bag checks, and compensation when a scheduled shift gets cut short. Some examples of wage violations in grocery and retail workers include:

  1. Denied seating where work reasonably permits: California's "suitable seating" rule requires employers to provide seats where the nature of the work allows, a common and often-overlooked violation. (Labor Code §1198 / IWC Wage Order, Section 14)

  2. Unpaid bag checks: Time spent on a required bag check at the end of your shift is compensable work time, not something you do off the clock.

  3. Reporting time pay violations: If you're scheduled and sent home early, you may be owed at least half your scheduled shift, with a minimum of two hours. (IWC Wage Order, Section 5)

  4. Missed meal and rest breaks: Standard CA meal/rest break rules apply. There’s no exception for retail or grocery environments.

  5. Off-the-clock stocking or cleanup tasks: If you're asked to stock shelves, clean, or close out registers before clocking in or after clocking out, that time may still count as hours worked. (Labor Code §510)
